A man in the Indian state of Assam landed in legal trouble after he posted a laughing emoji (haha) on a Facebook post that mocked a government official. According to a media report, Amit Chakraborty posted the emoji on a post mocking Varnali Deka, a deputy commissioner of Kokrajhar district, for not wearing makeup. Chakraborty, who had to get a surety bond, expressed his shock, saying: "I just commented on a post on Facebook... and because of my laugh, I have to get a surety bond now. You are guilty under this section, and I will file a complaint with the cybercrime unit." He continued, "I don't understand how a senior government official found the time to take such extreme action on such a trivial matter," adding, "Because of my reaction, because of a laughing emoji on Facebook, I was harassed." In response, Deka asked him, "What's your problem?". Following this exchange, Deka filed a complaint, naming Chakraborty, Barua, and a third man. As part of court proceedings, screenshots of the posts were submitted as evidence. In one of her replies, Deka warned Choudhary, saying: "I request you to check the anti-stalking section under Section 354D (of the Indian Penal Code)." However, Varnali took the matter very seriously and filed a lawsuit, after which the man, residing in Dhekiajuli, was summoned to the court in Kokrajhar, which is 273 km from his home. "I did not know that Varnali Deka is a government official or a deputy commissioner. You should have focused on your work instead of harassing me," she accused him. The official accused him, along with two other people, of cyberstalking and making insulting sexual comments. The case began when one of them commented on Deka's picture, asking, "No makeup today, madam?", according to a report by NDTV. Chakraborty, in turn, replied with a "haha" emoji, which Deka found offensive.
